Terms of Service

Welcome to modernsavage.co (the “Site”). These Terms of Service (“Terms”) apply to everyone who uses the Site and to everything you buy from it, whether you are in the UK or the US. By using the Site or placing an order, you agree to them.

For new UK orders placed on or after 2 October 2026, the seller is Modern Savage Ltd (company number 17395103), of 1 Sans Walk, London EC1R 0LT. For US orders and existing UK orders and subscriptions that remain with it, the seller is Modern Savage Inc., a company incorporated in Delaware, USA. References to ‘we’, ‘us’ and ‘our’ mean the relevant seller. You can reach us at any time at support@modernsavage.co.

Pre-orders

Modern Savage is currently sold on pre-order. That means you are reserving product from a batch that has not been manufactured yet, and it works differently from an ordinary purchase in two ways we want to be plain about:

  • Your card is charged in full when you order, not when we dispatch. Paying is what reserves your place in the first batch.
  • The delivery date is a target, not a guarantee. We are aiming to ship by the end of October 2026 for US orders and by the end of November 2026 for UK orders. If that date slips we will email you and tell you the new one, and you can cancel for a full refund at that point or at any point before dispatch.

You can cancel a pre-order at any time before it is dispatched and we will refund you in full, no reason needed. Email support@modernsavage.co with your order number and we will process it. This is our own promise and it sits on top of the statutory rights described below, it does not replace them.

If you are in the United States, the FTC Mail, Internet or Telephone Order Merchandise Rule also applies. If we cannot ship within the time we stated when you ordered, we will contact you with a revised date and the option to consent to the delay or cancel for a prompt full refund. If we cannot ship within 30 days of a revised date you have not agreed to, we will refund you without you having to ask.

Placing an order

The products listed on the Site are an invitation to order, not an offer. Your order is an offer to buy. A contract is formed when we send you an order confirmation email. If we cannot accept your order, for example because we cannot lawfully ship to your country or we have made a pricing error, we will tell you and refund you in full.

You must be at least 18 to buy from us. We currently accept orders for delivery to the United Kingdom and the United States, see our Shipping page.

Prices, currency and taxes

Orders delivered to the UK are priced and charged in pounds sterling. Orders delivered to the US are priced and charged in US dollars. The price you see at checkout, in the currency shown at checkout, is the price you pay.

Product prices for one-off purchases exclude delivery, which is added at checkout and shown before you pay. Subscription prices include delivery. Where sales tax or VAT applies it is calculated and shown at checkout. For deliveries that cross a customs border, import duties and taxes charged by the destination country are the recipient's responsibility, see our Shipping page.

We may change prices at any time, but never after you have placed an order. Subscriptions are the one exception, and only forwards: see Subscriptions below for how a change to a recurring price works and the notice you get before it applies.

Payment

Payments are processed by Stripe. We never see or store your full card number. By paying you confirm the card is yours or that you have permission to use it.

Subscriptions

If you choose a subscription, you are agreeing to a recurring payment and deliveries on a 28-day cycle. The price, the currency, the frequency and the minimum total cost of the two-delivery commitment are shown before you pay and repeated in your confirmation email. We email you before each renewal is charged. Subscriptions have a minimum of two deliveries, subject to your cancellation rights below. The minimum total cost is twice the price of one subscription delivery, including delivery charges.

You can cancel at any time before your first delivery is dispatched, for a full refund by emailing support@modernsavage.co. After your second delivery has been dispatched, you can cancel through your account to stop further renewals and deliveries, and you will not be charged again.

UK consumers: your right to cancel

If you are a consumer resident in the United Kingdom, you may cancel your subscription without giving a reason at any time from placing your order until the end of 14 days after the day on which you, or someone you nominate other than the carrier, receives your first delivery.

To exercise this right, email support@modernsavage.co with a clear statement that you wish to cancel. Please include your name and order number to help us identify your subscription. You can exercise this right even when the cancellation button in your account is unavailable. You do not need to wait for us to reply before the cancellation period expires.

Cancellation during this period ends the whole subscription, including the commitment to a second delivery. We will stop further deliveries and charges. Your rights to return goods already received and obtain a refund, including repayment of the cost of our standard outbound delivery, are governed by applicable consumer law. Our Returns & Refunds Policy explains the return and refund process, but does not restrict those rights.

General subscription terms

Outside your statutory cancellation rights and our promise of a full refund before the first dispatch, cancelling a subscription stops future renewals and deliveries but does not itself entitle you to a refund for goods already dispatched. This does not affect your rights if goods are faulty, damaged or not as described.

We will not increase the subscription price during your initial two-delivery commitment. After that, we may change the price for future renewals, but we will give you advance notice and a reasonable opportunity to cancel before the new price is charged.

Delivery, returns and refunds

Delivery times, rates and coverage are on our Shipping page. Your rights to return or cancel, including the UK 14-day cancellation right, are set out in full in our Returns & Refunds Policy. The Shipping Policy, Returns & Refunds Policy and Privacy Policy are incorporated into and form part of these Terms.

Risk in the goods passes to you on delivery. If something arrives damaged, faulty or wrong, we put it right, see the Returns policy.

About our products

Modern Savage sells food supplements. They are not medicines. Nothing on this site is medical advice. If you are pregnant, breastfeeding, taking medication or have a health condition, talk to your doctor first.

Statements made on this website about our products have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Individual results may vary. Any information provided on this website is for general informational purposes only and should not be relied upon as medical advice.

The content on this site is intended for people aged 18 or older.

Your account

Placing an order creates an account under the email address you ordered with, so you can see your order history and manage a subscription. There is no password: we email a secure sign-in link to that address. Keep that link to yourself, and tell us if you think someone else has access to your inbox.

Newsletter and emails

If you sign up to the newsletter, you're giving us permission to email you with product news, drops and offers. You can unsubscribe at any time from the link in every email, or by emailing us. Transactional emails about an order you placed are not marketing and are sent whether or not you subscribe. What we do with your email address is described in our Privacy Policy.

Intellectual property

All content on modernsavage.co, including text, images, photography, logos, product recipes and brand, is owned by Modern Savage and protected by copyright and trade mark laws in the UK, the US and internationally. You may view and share our content for personal, non-commercial use. Please do not copy, reproduce, scrape or use it commercially without our written permission.

Acceptable use

Please don't:

  • try to break, overload or work around security on the site
  • scrape or copy site content in bulk
  • impersonate anyone
  • submit content that is unlawful, abusive, harmful or misleading

We may block access from networks that do.

The Site is provided “as is”, limitations

We work hard to keep everything accurate and the Site working, but we can't promise it will always be available, bug-free or that information on it is complete.

For users other than consumers resident in the United Kingdom, to the fullest extent permitted by law, the Site and its content are provided “as is” and “as available”, we disclaim all implied warranties, and we are not liable for any loss that is not directly caused by us.

Nothing in these Terms takes away your rights as a consumer, including under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 in the UK, and in the US under the consumer-protection laws of your home state.

THE EXCLUSIONS AND LIMITATIONS IN THIS SECTION DO NOT APPLY TO CONSUMERS RESIDENT IN THE UNITED KINGDOM. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODERN SAVAGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, HEALTH OUTCOME, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Our responsibility to UK consumers

If you are a consumer resident in the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, when the contract was made, both you and we knew it might happen.

We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, liability for defective products under the Consumer Protection Act 1987, or any other liability which cannot lawfully be excluded or limited.

Nothing in these Terms affects your statutory rights, including your rights to receive products that are of satisfactory quality, fit for purpose and as described, and your rights and remedies if they are not.

We supply products for domestic and private use. We are not liable for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity.

This section takes precedence over any conflicting provision in these Terms.

Third-party links

The Site may link to other sites (for example Instagram). We are not responsible for the content, products or privacy practices of those sites, and a link does not imply endorsement.

Force majeure

We are not responsible for delays or failures to perform our obligations where caused by events beyond our reasonable control, including natural disasters, pandemics, war, civil unrest, government action, supplier shortages, manufacturing delays, transportation disruptions, customs delays, or failures of third-party service providers. If such an event affects an order, we will notify affected customers and provide an updated delivery estimate. Nothing in this clause affects any rights that cannot be excluded under applicable law, and nothing in it affects your right to cancel a pre-order for a full refund at any time before dispatch, including when a delay is what prompts you to cancel.

Changes to these Terms

We may update these Terms. The version that applies to your order is the one published when you placed it. We will update the date at the top of this page when anything changes, and flag material changes in the announcement bar at the top of the Site.

Governing law

Which law applies depends on where you live, because we sell into two markets and it would not be fair to make either side travel.

  • If you live in the United States: these terms are governed by the laws of the State of Delaware, without regard to conflict of law rules, and the state and federal courts located in Delaware will have exclusive jurisdiction, except where applicable consumer protection laws provide otherwise. Before bringing a legal claim, you agree to contact us at support@modernsavage.co and give us 30 days to attempt to resolve the issue informally.
  • If you live in the United Kingdom: these terms are governed by the laws of England and Wales, and disputes will be handled by the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may instead bring a claim in your home country's courts.
  • Wherever you live, nothing in these terms removes any mandatory consumer protection you have under the law of your home country or state.

Severability and waiver

If any provision of these Terms is found invalid or unenforceable, the rest remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of our right to enforce it later.

Product descriptions and availability

We strive to provide accurate descriptions, images, pricing, and other information about the products and services offered on the Site. However, we do not guarantee that all information is complete, accurate, current, or free from errors. Product images and descriptions are provided for informational purposes only and should not be considered endorsements.

Product details, including colours, dimensions, weights, capacities, and performance specifications, may vary and should be considered approximate. Colours displayed on your device may differ from actual product colours, and some information is based on details provided by manufacturers or other third parties.

We may update, modify, or correct information on the Site at any time without notice, including product descriptions, pricing, availability, or other content.

All products and services, including prices, fees, and availability, are subject to change. Modern Savage reserves the right to limit quantities, discontinue products or services, or refuse orders at its discretion. Not all products are available in all locations or at all times.

No medicines or medical advice

Always consult your physician or another qualified healthcare professional before beginning any exercise, training, expedition, diet, or health-related programme, before taking any medication, or if you have any questions or concerns regarding your health.

The products sold through the Site and any statements made about those products have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise. Our products are not intended to diagnose, treat, cure, or prevent any disease. Information provided on the Site should not be used as a substitute for professional medical advice or for the information contained on product labels, packaging, or instructions.

Individual experiences and user comments

Individuals may experience products differently, and your experience with a product may not be the same as someone else's.

Modern Savage employees and customers may provide comments, feedback, or reviews, and may share personal opinions or experiences with products. Any such comments reflect the individual's personal views only and do not constitute statements, guarantees, endorsements, or representations by Modern Savage.
